User Agreement
一、服务定义
1.1神舟商旅管理（https://btogo.com.cn）（以下简称“神舟商旅”）系北京神舟商务旅行管理有限公司建设、运营的商旅管理平台。神舟商旅提供的商品或者服务（以下统称“服务”）将完全按照法律规定、本协议约定内容及其发布的相关服务条款、交易规则和操作规则履行自身义务。为获得神舟商旅平台内服务，您应当同意本协议的全部条款。
二、协议目的
2.1本协议是以约定用户使用神舟商旅提供的网络服务时，神舟商旅与用户间的权利、义务、服务条款等基础事宜为目的。
三、遵守法律
3.1用户同意遵守《中华人民共和国保密法》、《计算机信息系统国际联网保密管理规定》、《中华人民共和国计算机信息系统安全保护条例》、《计算机信息网络国际联网安全保护管理办法》、《中华人民共和国计算机信息网络国际联网管理暂行规定》及其实施办法等相关法律法规的任何及所有的规定，并对用户以任何方式使用服务的任何行为及其结果承担全部责任。
四、服务内容
4.1神舟商旅服务的具体内容由神舟商旅根据实际情况提供和展示，神舟商旅保留随时变更、中断或终止部分或全部神舟商旅服务的权利。但变更、中断或终止服务不得损害用户的合法权益。
4.2用户在使用神舟商旅代为预订机票、酒店、火车票、用车等服务时，应仔细查看其详情及预订须知、退改签（如有）内容。
4.3用户在预订下单时须进行相应预付，下单后神舟商旅将根据用户订单信息进行服务确认和代为预订，并及时反馈服务代为预订结果。在服务预订失败时，原路退还用户所支付的预订款项。
4.4用户在相关服务预订成功后要求退、改、签操作的，可以在神舟商旅登录账户或者致电客服进行相应操作，费用扣减规则按照神舟商旅系统里的退改签规则执行。
4.5用户如与服务提供者产生相关服务质量争议，可以要求神舟商旅配合其提供相关信息。如经神舟商旅确认成功出票后因神舟商旅原因致使用户无法取得相应服务的，则神舟商旅承担用户的直接损失。
4.6本协议未约定的事项由双方在订单中进一步明确，如订单中也未进行约定的，则按照相关法律执行。
五、用户的权利及义务
5.1用户在申请使用神舟商旅账号接受服务时，必须向神舟商旅如实提供准确、有效的个人信息（包括身份信息、联系信息，以下简称“个人信息”）。其中联系号码信息须经过网络服务商实名认证，如个人信息有任何变动或者联系号码未经实名认证及联系号码认证的实名与个人身份信息不符的，必须及时登录更正、更新，否则因信息失效或者错误导致的损失或者费用均由用户承担。
5.2神舟商旅将给予每个用户一个用户帐号及相应的密码，该用户帐号和密码由用户自行保管和保密，不得转让、转借他人操作，否则均视为用户自身操作行为；用户应当对以其用户帐号进行的所有活动内容的真实有效性负法律责任。所有活动内容包括但不限于下单、支付、变更、陈述、评论、投诉及上传声像信息等等（以下简称“用户平台信息”）。
5.3用户在使用神舟商旅服务过程中，必须遵循以下原则：
5.3.1遵守中国现行的法律和法规；
5.3.2不得为任何非法目的而使用神舟商旅；
5.3.3遵守所有与网络服务有关的网络协议、规定和程序；
5.3.4不得利用神舟商旅传输任何危害社会，侵蚀道德风尚，宣传不法宗教组织等内容；
5.3.5不得利用神舟商旅进行任何可能对互联网的正常运转造成不利影响的行为；
5.3.6不得利用神舟商旅上载、张贴或传送任何非法、有害、胁迫、滥用、骚扰、侵害、中伤、粗俗、猥亵、诽谤、侵害他人隐私、辱骂性的、恐吓性的、庸俗淫秽的及有害或性别、种族歧视的或道德上令人不快的包括其他任何非法的信息资料；
5.3.7不得利用神舟商旅进行任何不利于神舟商旅网站的行为；
5.3.8如发现任何非法使用用户帐号或帐号出现安全漏洞的情况，应立即通知神舟商旅。
5.4 用户有权对其接受的服务作出或上传真实、客观的用户平台信息，且神舟商旅不得删除真实、客观的用户平台信息。但用户不得作出或者上传违背事实、无中生有的虚假用户平台信息，更不得作出或者上传恶意诋毁和贬损的用户平台信息。
5.5如因用户平台信息侵犯平台内经营者、其他用户或者第三方合法权益的，则神舟商旅有权根据上述权利人要求删除相关用户平台信息。
六、神舟商旅的权利及义务
6.1除特殊情况外（例如：协助行政、司法机关部门调查等），神舟商旅努力保护用户的个人信息不被外漏，且不得在未经用户的同意下向第三者提供用户个人信息。
6.2神舟商旅根据提供服务的用户反馈及经营上的政策变化，无需用户同意即可更改，变更所提供服务的具体内容，但不得由此损害用户已购服务的合法权益。
6.3神舟商旅在提供服务过程中，应及时解决用户提出的合理诉求。如用户与平台内经营者产生争议，神舟商旅可居中协调。两方协调不成的，神舟商旅有义务协助用户提起投诉或者诉讼。
6.4神舟商旅在下列情况下可以不通知用户，直接删除其用户平台信息：
6.4.1有损于神舟商旅、其他用户或第三者名誉的内容；
6.4.2利用神舟商旅上载、张贴或传送任何非法、有害、胁迫、滥用、骚扰、侵害、中伤、粗俗、猥亵、诽谤、侵害他人隐私、辱骂性的、恐吓性的、庸俗淫秽的及有害或种族歧视的或道德上令人不快的包括其他任何非法的内容；
6.4.3侵害神舟商旅或第三者的著作权、商标权等知识产权内容；
6.4.4存在与神舟商旅或者平台内经营者提供的服务完全无关的内容；
6.4.5盗用他人神舟商旅账号，并张贴或传送任何内容及恶意更改，伪造他人上载内容。
6.4.6在神舟商旅上制作、复制、发布、传播具有反动、色情、暴力、淫秽等内容的信息。
6.4.7其他严重侵害神舟商旅、其他神舟商旅用户、平台内经营者及第三者的合法权益的内容或者评论。
6.5用户同意神舟商旅以一般社会人的非专业角度合理地评判用户是否违反本协议约定及依据本协议约定采取相应的措施。
6.6用户在神舟商旅与平台内经营者签订的合同由合同双方按照约定履行各自义务。如在履行上述过程中平台内经营者涉嫌虚假宣传欺诈、胁迫用户的行为，用户有权向神舟商旅反馈，神舟商旅有义务协助用户向平台内经营者追偿。
七、知识产权
7.1神舟商旅所有的商品、技术、程序、页面（包括但不限于页面设计及内容）以及资料内容（包括但不限于本站所刊载的图片、 视频、Flash等）均属于知识产权，仅供用户交流、学习、研究和欣赏，未经授权，任何人不得擅自使用、转载和编辑，否则，将依法追究法律责任。
7.2用户同意神舟商旅免费在其网络不同页面上呈现用户上传的资料内容，作为正面宣传、展示。神舟商旅不得作为负面宣传、展示或者对用户形象有诋毁或者贬低。
八、免责声明
8.1用户在使用神舟商旅过程中如因自身软件运行环境、设备原因或者自身设备遭受网络病毒攻击而可能遭致的意外及其造成的损失，神舟商旅对此概不负责，亦不承担任何法律责任。
九、服务变更、中断或终止
9.1如因神舟商旅维护或升级的需要而需暂停提供服务，神舟商旅将尽可能事先进行通告，保护用户相关合法权益。
9.2如发生下列任何一种情形，本网站有权随时中断或终止向用户提供本协议项下的服务：
9.2.1有证据证明用户提供的个人信息、陈述不真实（包括失效状态）且经催告后不予更正、更新的；
9.2.2用户、平台内经营者违反法律、行政法规在神舟商旅上从事扰乱社会治安、犯罪；
9.2.3违反本协议5.3或6.4条款的。
9.3除前款所述情形外，在出现不可抗力、政府部门介入要求停止对外服务或者其他已尽合理注意义务但仍无法避免中断或终止服务的事项，神舟商旅有权在事先通知用户的情况下中断或终止部分或全部神舟商旅服务的权利，同时对于所有服务的中断或终止而造成的任何损失，神舟商旅无需对用户承担任何责任
9.4用户自行注销神舟商旅账号的，应在账号项下所有交易全部履行完毕方可实施，用户同意神舟商旅保留用户注册及使用过程中所有的个人信息和用户平台信息。
十、违约赔偿
10.1用户同意保障和维护神舟商旅及其他用户的合法利益，如因用户违反有关法律、法规或本协议项下的任何条款而给神舟商旅或者其他用户及第三者造成损失，用户同意承担由此造成的损害赔偿责任。
10.2神舟商旅同意对用户个人及用户平台信息进行保密，保障个人信息及隐私。除为履行相关服务需要用户相关信息及行政、司法机关合理要求披露外，神舟商旅不得将用户上述信息向第三方披露、泄露或者转让。
十一、修改协议
11.1神舟商旅可能不时的修改本协议的有关条款，一旦条款内容发生变动，神舟商旅将会在相关的页面进行公示7日，征求用户意见。如用户无合理异议或者继续使用在神舟商旅注册的账号，则视为接受修订后的内容。如用户不同意变动相关内容，但又无法提出合理异议的，则用户可以选择停止使用账号或者在履行完毕所有账号项下的义务后自行根据系统提示注销账号。
十二、法律管辖
12.1本协议的订立、执行和解释及争议的解决均应适用中国法律。
12.2如双方就本协议内容或其执行发生任何争议，双方应尽量友好协商解决。
十三、其他规定
13.1除本协议约定定之外，用户将按照其与商户签订的商品合同及按照神舟商旅系统程序或流程进行的操作确认内容来履行自身义务和享有商品合同及确认内容赋予的各项权利。
13.2如本协议中的任何条款无论因何种原因完全或部分无效或不具有执行力，本协议的其余条款仍应有效并且有约束力。
13.3依据用户注册时或者其后变更、更新后的个人信息（包括但不限于电话、传真、邮箱、地址，以最后更新信息为准）所进行的送达，均视为有效送达。送达内容包括但不限于交易内容、结算的确认和变更，法律诉讼文书的送达。如出现送达被退回的，则送达人收到退回件之日视为有效送达之日。
13.4本协议在用户使用神舟商旅账号登录进入神舟商旅即视为用户同意本协议内容及对用户及神舟商旅均产生法律效力。
1. Service definition

1. The Purpose Of The Agreement
2.1 This agreement is for the purpose of stipulating basic matters such as the rights, obligations, and terms of service between BTG and the user when users use the network services provided by BTG.
3. Obey The Law
3.1 The user agrees to abide by the "Confidentiality Law of the People's Republic of China", "Regulations on the Confidentiality Management of Computer Information Systems International Networking", "Regulations on the Security Protection of Computer Information Systems of the People's Republic of China", "Management Measures for the Security Protection of Computer Information Networks International Networking", The Interim Provisions on the Administration of the International Networking of the Republic’s Computer Information Network and its implementation measures and any and all provisions of relevant laws and regulations, and assume full responsibility for any behavior and results of users using the service in any way.
4. Service Content
4.1 The specific content of BTG Service is provided and displayed by BTG based on actual conditions. BTG reserves the right to change, interrupt or terminate part or all of BTG services at any time. However, the change, interruption or termination of the service shall not damage the legitimate rights and interests of users.
4.2 When using BTG to book air tickets, hotels, train tickets, car use and other services, they should carefully check their details and booking instructions, refunds and changes (if any).
4.3 The user must make the corresponding prepayment when placing the order. After the order is placed, BTG will confirm the service and make the reservation based on the user's order information, and provide timely feedback on the service as the reservation result. When the service reservation fails, the same route will refund the reservation money paid by the user.
4.4 If the user requests refund, change, or sign-off operation after the relevant service is successfully booked, he can log in to the account at BTG or call the customer service to perform the corresponding operations. The fee deduction rules shall be implemented in accordance with the rules of refund and change in the BTG system.
4.5 If users have disputes about service quality with service providers, they can request BTG to cooperate with them to provide relevant information. If the user is unable to obtain the corresponding service due to BTG after confirming the successful ticket issuance, BTG shall bear the direct loss of the user.
4.6 Matters not agreed in this agreement shall be further clarified by both parties in the order. If they are not agreed in the order, they shall be implemented in accordance with relevant laws.
5. User's Rights And Obligations
5.1 When applying for the use of BTG account to receive services, users must truthfully provide BTG with accurate and valid personal information (including identity information and contact information, hereinafter referred to as "personal information"). The contact number information must be verified by the network service provider's real name. If there is any change in personal information or the contact number has not been verified by the real name and the real name of the contact number verification does not match the personal identity information, it must be logged in and corrected and updated in time, otherwise the information becomes invalid or The loss or expense caused by the error shall be borne by the user.
5.2 BTG will give each user a user account and corresponding password. The user account and password shall be kept and kept confidential by the user, and shall not be transferred or lent to others for operation, otherwise it shall be regarded as the user’s own operation; the user shall treat his user The authenticity and validity of all activities carried out by the account shall be held legally responsible. All activities include but are not limited to placing orders, payments, changes, statements, comments, complaints and uploading audio and video information, etc. (hereinafter referred to as "user platform information").
5.3 In the process of using BTG Service, users must follow the following principles:
5.3.1 Comply with the current laws and regulations in China;
5.3.2 Not to use BTG for any illegal purpose;
5.3.3 Comply with all network protocols, regulations and procedures related to network services;
5.3.4 Not to use BTG to transmit any content that harms society, erodes morals and customs, promotes illegal religious organizations, etc.;
5.3.5 Do not use BTG to conduct any behavior that may adversely affect the normal operation of the Internet;
5.3.6 Do not use BTG to upload, post or transmit any illegal, harmful, intimidating, abusive, harassing, infringing, slanderous, vulgar, obscene, slanderous, infringing on the privacy of others, abusive, intimidating, vulgar, obscene, or harmful Or sexual, racially discriminatory or morally unpleasant, including any other illegal information;
5.3.7 Do not use BTG to conduct any behavior that is detrimental to the BTG website;
5.3.8 If you find any illegal use of user accounts or account security loopholes, you should immediately notify BTG.
5.4 Users have the right to make or upload true and objective user platform information for the services they receive, and BTG shall not delete true and objective user platform information. However, users are not allowed to make or upload false user platform information that violates facts and is made out of nothing, let alone maliciously slander and derogatory user platform information.
5.5 If the user platform information infringes on the legitimate rights and interests of operators, other users or third parties on the platform, BTG has the right to delete the relevant user platform information according to the request of the above right holder.
6. BTG's Rights And Obligations
6.1 Except for special circumstances (for example: assisting administrative and judicial departments in investigations, etc.), BTG strives to protect users' personal information from leakage, and must not provide users' personal information to third parties without the user's consent.
6.2 According to user feedback provided by the service and changes in operating policies, BTG can change the specific content of the services provided without the user's consent, but shall not damage the legitimate rights and interests of the user's purchased services.
6.3 In the process of providing services, BTG shall promptly resolve reasonable requests raised by users. If there is a dispute between users and operators on the platform, BTG can coordinate in the middle. If the two parties fail to coordinate, BTG is obliged to assist users in filing complaints or lawsuits.
6.4 BTG can directly delete its user platform information without notifying the user in the following cases:
6.4.1 Content that harms the reputation of BTG, other users or third parties;
6.4.2 Use BTG to upload, post or transmit any illegal, harmful, coercive, abuse, harassment, infringement, slander, vulgar, obscene, defamatory, infringement of the privacy of others, abusive, intimidating, vulgar, obscene and harmful or Racially discriminatory or morally unpleasant includes any other illegal content;
6.4.3 Infringement of copyright, trademark and other intellectual property rights of BTG or a third party;
6.4.4 There are contents completely unrelated to the services provided by BTG or the operators on the platform;
6.4.5 Misappropriating another person's BTG account, and posting or transmitting any content and malicious changes, forging content uploaded by others.
6.4.6 Produce, copy, publish, and disseminate information with reactionary, pornographic, violent, obscene and other content on BTG.
6.4.7 Other content or comments that seriously infringe upon the legitimate rights and interests of BTG, other BTG users, platform operators, and third parties.
6.5 The user agrees that BTG reasonably judges whether the user violates the provisions of this agreement from the non-professional perspective of the general public and takes corresponding measures in accordance with the provisions of this agreement.
6.6 The contract signed by the user between BTG and the operator on the platform shall be performed by both parties in accordance with the agreement. If in the process of performing the above-mentioned process, the operator on the platform is suspected of false propaganda, fraud, and intimidating users, the user has the right to give feedback to BTG, and BTG is obliged to assist the user in recovering from the operator on the platform.
7. Intellectual Property
7.1 All products, technologies, programs, pages (including but not limited to page design and content) and data content of BTG (including but not limited to pictures, videos, Flash, etc.) published on this site are intellectual property rights and are for users only For communication, study, research and appreciation, no one is allowed to use, reprint or edit without authorization, otherwise, legal responsibility will be investigated according to law.
7.2 The user agrees that BTG will present the content of the information uploaded by the user on different pages of its network for free as a positive publicity and display. BTG shall not serve as negative publicity, display, or slander or belittle the image of users.
8. Disclaimer
8.1 In the process of using BTG, if the user's own software operating environment, equipment reasons or his own equipment is attacked by a network virus may cause accidents and losses, BTG shall not be responsible for this, and shall not bear any legal responsibility. .
9. Service Change, Interruption Or Termination
9.1 If the provision of services needs to be suspended due to the maintenance or upgrade of BTG, BTG will make advance notice as far as possible to protect the relevant legal rights and interests of users.
9.2 In the event of any of the following situations, this website has the right to suspend or terminate the provision of services under this agreement to users at any time:
9.2.1 There is evidence to prove that the personal information and statement provided by the user are not true (including the invalid state) and will not be corrected or updated after a reminder;
9.2.2 Users and operators on the platform violated laws and administrative regulations and engaged in disrupting public security and crimes on BTG;
9.2.3 Violation of clause 5.3 or 6.4 of this agreement.
9.3 In addition to the circumstances described in the preceding paragraph, in the event of force majeure, government intervention to request the cessation of external services, or other matters that have performed reasonable care but still cannot avoid interruption or termination of services, BTG has the right to interrupt the user with prior notice Or terminate the right to part or all of BTG’s services. At the same time, BTG does not need to bear any responsibility to the user for any losses caused by the interruption or termination of all services.
9.4 If the user cancels the BTG account by himself, it shall be implemented after all transactions under the account are completed. The user agrees that BTG will retain all personal information and user platform information during the user registration and use process.
10. Compensation For Breach Of Contract
10.1 The user agrees to protect and maintain the legitimate interests of BTG and other users. If the user violates relevant laws, regulations or any clauses under this agreement and causes losses to BTG or other users or third parties, the user agrees to bear this Liability for damage caused.
10.2 BTG agrees to keep the user's personal and user platform information confidential to protect personal information and privacy. Except for the relevant information of users and the reasonable requirements of administrative and judicial authorities to disclose in order to perform related services, BTG shall not disclose, divulge or transfer the above information of users to third parties.
11. Modify The Agreement
11.1 BTG may revise the relevant terms of this agreement from time to time. Once the content of the terms is changed, BTG will publicize on the relevant page for 7 days and solicit user opinions. If the user has no reasonable objections or continues to use the account registered in BTG, it will be deemed to accept the revised content. If the user does not agree with the changes to the relevant content, but is unable to raise a reasonable objection, the user can choose to stop using the account or cancel the account according to the system prompts after fulfilling all the obligations under the account.
12. Legal Jurisdiction
12.1 The conclusion, execution and interpretation of this agreement and dispute resolution shall be governed by Chinese laws.
12.2 If there is any dispute between the two parties on the content of this agreement or its implementation, the two parties shall try their best to resolve it through friendly negotiation.
13. Other Regulations
13.1 Except as stipulated in this agreement, users will perform their own obligations and enjoy the rights granted by the product contract and confirmation content in accordance with the commodity contract signed with the merchant and the operation confirmation content in accordance with the procedures or procedures of the BTG system.
13.2 If any clause in this agreement is completely or partially invalid or not enforceable for any reason, the remaining clauses in this agreement shall still be valid and binding.
13.3 The delivery based on the personal information (including but not limited to telephone, fax, email, address, and the last updated information) that is changed or updated at the time of user registration or thereafter shall be deemed effective. The content of service includes, but is not limited to, transaction content, confirmation and change of settlement, and service of legal proceedings. In the event that the delivery is returned, the date on which the delivery person receives the return shall be regarded as the date of effective delivery.
13.4 This agreement shall be deemed that the user agrees to the content of this agreement and has legal effect on both the user and the BTG when the user logs in with the BTG account to enter the BTG.
